DNA Tours Limited, trading as Forty Five South ("we", "us", "our"), respects your privacy. This policy explains what personal information we collect, why we collect it, what we do with it, and the rights you have over it. We handle personal information in accordance with the New Zealand Privacy Act 2020 and its Information Privacy Principles.

1. Who We Are

2. The Information We Collect

Information you give us.
When you enquire, book, travel with us or subscribe to our newsletter, we may collect:

• your name, and the names of everyone travelling with you
• contact details — email address, phone number, postal address, country of residence
• passport details, date of birth and nationality, where a supplier or airline requires them
• flight and arrival details
• payment information, including card or bank account details
• dietary requirements, allergies, and medical or accessibility information you choose to share so we can look after you properly
• emergency contact details
• your travel preferences, interests and anything else you tell us that helps us design a better journey
• your travel insurance details
• feedback, reviews and correspondence with us

Information we collect automatically. When you visit our website we may collect your IP address, browser and device type, the pages you view, the site that referred you, and similar analytics data. We do this through cookies and analytics tools — see section 8.

Sensitive information. Health, dietary and accessibility information is only collected where you provide it to us, and is used only to make your journey safe and comfortable. We share it with a supplier — a lodge, a chef, an activity operator — only to the extent they need it to look after you, and never for any other purpose.

3. Information We Collect From Others

Sometimes we receive personal information about you from someone other than you. This usually happens when:

• another member of your travelling party — a lead traveller, a family member, an assistant — makes the booking and provides your details to us
• a travel agent, travel designer or destination management company books a journey with us on your behalf
• a supplier we have booked passes information back to us in the course of delivering your itinerary

Where we collect your information indirectly, we take reasonable steps to make sure you are aware that we hold it, what it is, why we have it, who we may share it with, and how you can access and correct it — usually by providing you with this policy directly. This reflects our obligations under information privacy principle 3A, which came into force on 1 May 2026.

If you are booking for other people: please make sure everyone in your party has seen this policy and is comfortable with you giving us their information.

4. Why We Collect It, and How We Use It

We collect personal information for the following purposes:

• to respond to your enquiry and prepare a proposal
• to design, book, confirm and operate your journey
• to make bookings on your behalf with accommodation providers, activity operators, transport and charter operators, restaurants and other suppliers
• to keep you safe, and to make sure our suppliers can meet your dietary, medical and accessibility needs
• to process payments and manage refundsto communicate with you before, during and after your journeyto respond to complaints and resolve issues
• to meet our legal, tax and insurance obligationswith your consent, to send you our newsletter and occasional updates
•to improve our service, our website and our itineraries

We will not use your personal information for a purpose other than the one it was collected for, unless you consent, or unless the Privacy Act permits or requires it.

5. Who We Share It With

We share your personal information only where it is necessary:

With suppliers. To arrange your journey we must pass relevant details — names, dates, dietary and medical requirements, and weights where an aviation operator requires them — to the accommodation providers, guides, airlines, helicopter and charter operators, activity operators and restaurants involved in your itinerary. We share only what each supplier needs.

With our service providers. We use third parties for functions such as payment processing, email, customer relationship management, website hosting and analytics. They may access personal information only to perform those functions for us.

With our advisors and insurers, where necessary.

Where the law requires it, or where disclosure is necessary to prevent or lessen a serious threat to someone's life, health or safety.We do not sell your personal information, and we do not trade or rent our mailing list.

6. Information Sent Overseas

Some of the software providers we use — including email, cloud storage, payment and analytics services — are located outside New Zealand, or store information on servers located overseas. This means your personal information may be held in, or accessed from, countries other than New Zealand.

Before we disclose your information to anyone outside New Zealand, we take reasonable steps to satisfy ourselves that the recipient is required to protect it with safeguards comparable to those in the Privacy Act 2020, as required by information privacy principle 12. Where those safeguards are not in place, we will only send your information overseas with your authorisation, having first made clear to you that it may not be protected to the same standard as it would be here.

7. Storage, Security and Retention

We store personal information on secure systems and take reasonable technical and organisational steps to protect it against loss, misuse, and unauthorised access, modification or disclosure. Access within our team is limited to people who need it to do their job.

No system is perfectly secure, and no transmission over the internet can be guaranteed. We cannot promise absolute security, but we take our obligations here seriously.

We keep personal information only for as long as we need it for the purposes set out in this policy, or for as long as we are required to keep it by law — for example, for tax and financial records. When we no longer need it, we securely delete or de-identify it.

Privacy breaches. If a privacy breach occurs and it is reasonable to believe it has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and the affected individuals as soon as practicable, as required by the Privacy Act 2020.

8. Cookies and Our Website

Our website uses cookies — small files stored on your device — to make the site work, to remember your preferences, and to help us understand how visitors use the site so we can improve it.

We use Google Analytics to understand how people find and use our website. Google Analytics sets its own cookies and collects information such as your IP address, the pages you visit, how long you spend on them, and the site or search that brought you here. This helps us see which parts of our site are useful and which are not. The information is processed by Google, which may store and process it outside New Zealand. You can read how Google handles it at policies.google.com/privacy, and you can opt out of Google Analytics across all websites using Google's browser add-on at tools.google.com/dlpage/gaoptout.

You can control or disable cookies through your browser settings. Some parts of the site may not work properly if you do.

Our website may contain links to other sites — suppliers, partners, official travel resources. We are not responsible for the privacy practices of those sites, and we would encourage you to read their policies.

9. Marketing

If you subscribe to our newsletter, or if you have travelled with us, we may send you occasional updates and travel inspiration. Every message includes an unsubscribe link, and we will act on it promptly. You can also ask us to stop at any time by emailing info@fortyfivesouth.co.nz.

Unsubscribing from marketing does not stop us sending you communications relating to a booking you have made.

10. Your Rights

Under the Privacy Act 2020, you have the right to:ask us for access to the personal information we hold about youask us to correct it if it is wrong, incomplete or out of date.

To make a request, email us at info@fortyfivesouth.co.nz. We may need to verify your identity first. We will respond as soon as we reasonably can, and within 20 working days of receiving your request, as the Act requires.

There is no charge for a request in most cases. If a request is unusually large or complex, we may charge a reasonable fee, and we will tell you before we do.

If we decline to correct information, you may ask us to attach a statement of the correction you sought, and we will do so.

11. Children

Our services are directed at adults, and we do not knowingly collect personal information directly from children. Where children are travelling with you, we collect only the information we need to look after them, and we collect it from the adult making the booking.

12. Complaints

If you are unhappy with how we have handled your personal information, please contact us first at info@fortyfivesouth.co.nz — we will take it seriously and try to put it right.

If you are not satisfied with our response, you have the right to complain to the Office of the Privacy Commissioner:

13. Changes to This PolicyWe may update this policy from time to time. The current version is always the one published on this page, and the date at the top tells you when it was last changed. Where a change is significant, we will take reasonable steps to let you know.
